Data Processing Agreement (DPA)

This Data Processing Agreement (“DPA”) forms an integral part of the Wanexa Terms of Service between Wanexa (“Data Processor”) and You (“Data Controller”). This DPA governs the processing of personal data in connection with the WhatsApp API and Automation services provided by Wanexa.

1. Roles & Scope of Processing

• Data Controller: You determine the purposes and means of processing personal data (your end-customers’ details and message content).
• Data Processor: Wanexa processes personal data solely on your behalf and according to your instructions to deliver SaaS functionality.

1. Data Processing Details

• Subject Matter: Processing WhatsApp messaging data, contacts, CRM attributes, and interaction logs.
• Duration: For the term of your active subscription with Wanexa.
• Categories of Data Subjects: Your business leads, users, and customers interacting with your WhatsApp Channel.

1. Security Measures
   Wanexa implements appropriate technical and organisational measures to safeguard processed data against accidental or unlawful destruction, loss, alteration, or unauthorised disclosure.

1. Sub-processors
   You authorise Wanexa to engage sub-processors (such as Meta Platforms, Inc. for WhatsApp infrastructure and cloud hosting providers) necessary for service delivery. All sub-processors are bound by data protection obligations consistent with this DPA.

1. Data Breach Notification
   In the event of a confirmed personal data breach affecting your data, Wanexa will notify you without undue delay after becoming aware of the incident.

1. Termination & Data Deletion
   Upon termination of your account, Wanexa will delete or return all customer data stored on our platform, except where retention is required by applicable laws.
